1. Introduction

Overview: Welcome to dotty.cc ("Site"), a website offering various web-based tools and utilities (the "Services"). The Site is owned and operated by Barranjoey Capital Pty Limited (ABN 85 630 955 387), located at Level 2, Westfield Chermside, Kittyhawk Drive, Chermside, Queensland 4032, Australia ("Barranjoey," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of dotty.cc and its Services. By using the Site, you are entering into a binding agreement with Barranjoey under these Terms.

Acceptance: PLEASE READ THESE TERMS CAREFULLY. By accessing or using dotty.cc, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy which is incorporated herein by reference. If you do not agree with any part of these Terms or the Privacy Policy, you must not use the Site or Services. Use of the Services is also subject to any other policies or guidelines we may provide for specific tools or features.

Capacity and Scope: You represent that you have the legal capacity to agree to these Terms. If you are using the Services on behalf of an organisation or entity, you are agreeing to these Terms for that entity and representing to us that you have authority to bind that entity to these Terms. These Terms apply to all users of dotty.cc, including individuals accessing tools manually (humans), automated agents or AI accessing the tools, and developers integrating our utilities into other applications.

2. Description of Services

Services Provided: Dotty.cc offers a suite of free web-based tools and utilities designed for a variety of purposes, which may include (but are not limited to) text and data processing, AI-assisted functions, coding utilities, mapping/geolocation tools, and other developer or productivity services. Our tools are intended for personal and lawful use by end-users, and in some cases may be accessed programmatically by developers or AI agents. There is no user registration or account creation required to use the free Services at this time; users can typically access tools anonymously or as guests.

Free Usage and Future Paid Tiers: Currently, our Services are provided free of charge for personal or evaluation use. However, usage is subject to fair use limits (for example, a reasonable number of requests per day per user or IP address). We reserve the right to define what constitutes personal/fair use and may enforce usage limits to prevent abuse or excessive use of our free Services. In the future, we may introduce paid subscription plans or usage-based billing for access beyond a defined free usage allowance or for premium features. We will provide details (such as pricing and usage limits) and possibly separate or additional terms when such paid tiers are launched (see Section 11 on Fees and Payments). By continuing to use the Services after paid features are introduced, you agree to pay any applicable fees and to abide by any updated terms for those features.

Beta Features and Modifications: The specific tools and functionalities available on dotty.cc may change over time as we improve our offerings. We may add, remove, or modify tools, features, or the interface at our discretion as part of ongoing development. All new features or tools added to the Site will also be subject to these Terms. We strive to maintain reliable and accessible services, but we do not guarantee that any specific tool or feature will always be available or error-free. Section 8 (Disclaimers) provides more detail on service availability.

3. Changes to Terms

Right to Update: Barranjoey reserves the right to revise or update these Terms at any time. If we make material changes, we will notify users by posting the updated Terms on this page and updating the "Last Updated" date above. In some cases (for significant changes), we may also provide additional notice, such as a banner on our site or an email notification if we have a way to contact you. Continued Use = Acceptance: By continuing to access or use the Site after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the revised Terms, you must stop using the Services. It is your responsibility to review these Terms periodically for updates.

Modifications to Services: In addition to updating Terms, we may at any time discontinue, temporarily or permanently, the Site or any portion of the Services, or change the manner in which the Services operate (for example, introducing new usage limits or requiring fees for certain levels of service). We may do so with or without notice (though we will try to provide advance notice for major changes when feasible). Barranjoey shall not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services. If you have paid for a service that is then discontinued or materially altered, we will handle such situations in accordance with Section 11 (Fees and Payments) and applicable law.

4. Eligibility and User Obligations

Minimum Age: The Services are intended for adults and adolescents who can form legally binding contracts. By using dotty.cc, you represent that you are at least 18 years old, or if you are between 13 and 18 (or the age of majority in your jurisdiction), that you are using the Site with the consent of a parent or legal guardian who accepts these Terms on your behalf. The Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If you do not meet these age requirements, you must not use the Site.

User Responsibilities: When using our Site and Services, you agree to comply with the following obligations and any applicable laws or regulations:

Lawful Use Only: You will use the Services only for lawful purposes. You shall not use dotty.cc to engage in any illegal, fraudulent, or malicious activities. This includes not using the tools to create, upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or otherwise objectionable or that violates any law or regulation.

No Violation of Rights: You will not use the Services to infringe or misappropriate the intellectual property rights or other rights of any person or entity. This means you must not upload or submit any content to our Site that you do not have the right to use, and you must not use any output or information from our Site to violate others' copyrights, trademarks, privacy, publicity, or other rights.

No Harmful Code: You must not introduce to the Site any viruses, worms, malware, spyware, or any other code that is malicious or technologically harmful. You agree not to use the Services to distribute unauthorised advertising or spam, or to engage in practices like phishing or pretexting.

No Service Interference or Abuse: You will not interfere with or disrupt the integrity or performance of our Site or Services, including not attempting to gain unauthorised access to any part of the Site, the server infrastructure, or other users' data. Prohibited actions include (but are not limited to) attempting to bypass any security or access controls, reverse engineering the software or source code of the Site, launching any form of denial-of-service attack, or using any automated means (such as scripts, bots, or scrapers) to access the Services in a manner that sends more requests to the servers than a human could reasonably produce in the same time. (Exception: If we offer developer APIs or allow AI agents to use the Services, such usage must comply with all posted guidelines and rate limits. Automated use is only permitted to the extent it does not disrupt the Service or exceed granted usage levels.)

Compliance with Applicable Laws: You agree to comply with all applicable local, national, and international laws and regulations in connection with your use of dotty.cc. This includes (where applicable) data privacy laws, export control and sanctions laws, and any requirements in your jurisdiction. You represent that you are not located in a country or on any persons list that is subject to trade sanctions or export restrictions (e.g., lists maintained by the U.S., E.U., U.N. or Australia), and you will not use the Services for the benefit of any entity or country prohibited by such sanctions.

No Unauthorised Personal Data: Because some tools may generate publicly accessible results, you should refrain from submitting sensitive personal data unless specifically requested by a particular tool. You must not use the Services to collect or harvest personal data of others without proper consent or legal basis. If you handle personal data using our tools (for example, processing contact information), you are responsible for doing so in compliance with privacy laws such as GDPR or the Australian Privacy Act. You are also responsible for ensuring that any content you submit does not contain confidential information of third parties, unless you have their permission.

Consequences of Violation: If you violate any of these rules or any other provision of these Terms, we may take action including terminating or suspending your access to the Services (see Section 12 on Termination), removing any offending content, and/or cooperating with law enforcement as appropriate. You understand that you are responsible for any consequences of your misuse of the Site, and you agree to indemnify us for any claims or losses as described in Section 10 (Indemnification) if you violate the Terms.

5. User Content and Submissions

User Inputs and Uploads: Some of our tools allow or require you to enter text, data, images, code, or other content ("User Content"), or to upload files, in order to obtain a result or output. By providing any User Content to dotty.cc, you affirm that you own or have all necessary rights and permissions to submit that content and to grant the licenses below. You remain fully responsible for the content you submit, and you must ensure that no User Content violates these Terms or any law (for example, you must not upload content that is illegal, infringing, or contains sensitive personal data without authorisation).

License to Use User Content: In order for us to provide the Services, you grant Barranjoey a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, reproduce, modify, adapt, and display your User Content as needed to operate the tools or services you are using. For example, our systems may need to copy your input into memory and process it, transform it into a different format, or display it back to you (or to others, if you use a tool that publishes results publicly). This license is solely for the purpose of operating or improving the Services and fulfilling your requests; we do not claim ownership of your User Content, and ownership remains with you or your original licensor. Once you delete or remove your User Content from our systems (or it is automatically purged after processing), our license to that content will generally end, except to the extent we have archived copies as part of routine backups or we are required to retain content to comply with law or enforce our rights.

Public Output and Shared Content: Certain tools on dotty.cc may generate results that are meant to be shared or publicly accessible. For instance, you might use a tool that creates a short URL or a code snippet that is then accessible by anyone with the link, or a tool that allows you to publish some content for public viewing. In such cases, by using those tools and generating content, you agree that the output may be made public (either indexed or accessible by others), and you grant all other users of the Site and the general public a license to access, view, and use that output content. If you prefer to keep results private, please use tools that clearly indicate the output will remain private or download results to your own device without sharing links. We will identify when a tool's content is posted publicly, but ultimately you are responsible for what you choose to make public.

No Confidential or Sensitive Information: Because our Services are generally not designed for secure or permanent storage of data (and some outputs could be public), please do not submit any confidential information, trade secrets, or personal data that you would not want disclosed. We take precautions to secure data (see Privacy Policy), but we do not guarantee that User Content will remain confidential. Additionally, unless specifically stated by a particular tool, the Services are not meant for processing sensitive personal information (such as health data, financial information, or identification numbers). By providing any content, you understand and agree that it may be stored or processed by third-party providers (as detailed in Section 7 and our Privacy Policy). You are solely responsible for anonymising or removing sensitive details from your submissions if necessary to comply with your own privacy obligations.

6. Intellectual Property Rights

Our Content and Ownership: The Site and all content and materials available on dotty.cc (excluding your User Content) are the property of Barranjoey or our licensors, and are protected by intellectual property laws. This includes, without limitation, all software, code, algorithms, tools, text, graphics, logos, trademarks (such as the "dotty" name and logo), user interface design, compilations of data, and the overall look-and-feel and functionality of the Services (collectively, "Site Content"). Barranjoey retains all rights, title, and interest in and to the Site Content and the Services, including all related intellectual property and proprietary rights, except for rights expressly granted to you under these Terms. You do not acquire any ownership of any Site Content by using the Services or by copying or downloading materials from the Site.

Your Right to Use the Site: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use dotty.cc and the Site Content for your personal or internal business purposes. This license is provided solely for you to utilise the Services as intended (for example, to run the provided tools and obtain results for your own use). You may display or print content from the Site for your own use, but you must retain any copyright or proprietary notices. All rights not expressly granted to you are reserved by us.

7. Third-Party Services and Links

Third-Party Integrations: Dotty.cc integrates with or utilises several third-party services and content providers to function effectively. These third-party services are used for various technical, analytical, and functional purposes to support our tools. Key integrations include Google Services (Analytics, Cloud Platform, Fonts), Cloudflare (CDN and security), Nominatim & Photon (location services), and Redocly (API documentation).

Third-Party Terms and Privacy: These third-party services have their own terms and privacy policies that govern their use of any data they collect or process. By using our Site, you acknowledge and agree that your information may be transmitted to or through these third parties as needed for our Services to function. We do not control these third-party services and their operations, content, or data practices.

8. Privacy and Data Protection

Privacy Policy: Your privacy is important to us. Our practices concerning the collection, use, and disclosure of personal data are described in our Privacy Policy (available at dotty.cc/privacy). By using the Site or Services, you agree to the collection and use of information about you as outlined in the Privacy Policy.

Barranjoey is based in Australia and thus adheres to the Australian Privacy Act 1988 regarding the handling of personal information. Additionally, to the extent we offer services or collect data from individuals in other jurisdictions, we endeavor to comply with those jurisdictions' laws: for example, the EU/EEA General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA).

9. Disclaimers of Warranties

"As-Is" and "As-Available" Basis: Your use of dotty.cc and the Services is at your own risk. The Site and all Services, information, and content provided through it are provided "AS IS" and "AS AVAILABLE", without any warranties of any kind, either express or implied. Barranjoey does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that any results or outputs that you may obtain from the use of the Services will be accurate or reliable.

General Disclaimer of Warranties: To the fullest extent permitted by applicable law, Barranjoey disclaims all warranties and conditions of any kind (express, implied, or statutory) in relation to the Site and Services, including, but not limited to: implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from course of dealing or usage of trade.

10. Limitation of Liability

No Indirect Damages: To the maximum extent permitted by law, in no event shall Barranjoey or its directors, officers, employees, affiliates, agents, contractors, or licensors be liable to you for any indirect, incidental, consequential, special, punitive, or exemplary damages whatsoever arising out of or related to your use of (or inability to use) the Site or Services.

Cap on Direct Damages: To the extent we are found liable (and except as prohibited by law), our total cumulative liability to you for any and all claims arising from or related to the Services or these Terms shall not exceed the greater of: (a) the total amount (if any) you have paid to us for the use of the Services in the 12 months immediately preceding the event giving rise to the liability, or (b) AUD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Barranjoey Capital Pty Ltd, its parent, affiliates, and their respective officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) that arise out of or relate to: your use or misuse of the Site or Services; your violation of any of these Terms or of any law or regulation; your infringement or misappropriation of any intellectual property or other rights of any third party in connection with your use of the Services; or any User Content or submissions you provide.

12. Fees and Payments

Free Services: At present, the Services on dotty.cc are offered to users free of charge for personal or limited use. During this free access period, you are not required to provide any payment information. Barranjoey reserves the right to maintain the free nature of certain tools indefinitely.

Introduction of Paid Tiers: We plan to introduce paid subscription plans or pay-per-use tiers for users who require higher usage beyond the personal use limits, or who need access to premium features. When paid tiers are available, we will provide clear information about pricing and terms.

13. Termination and Suspension

Your Right to Stop Using: You may stop using the Site and Services at any time. Since we do not have user accounts for free users, there is no special process needed to terminate usage—ceasing to use the tools is sufficient.

Our Right to Suspend or Terminate: We reserve the right to suspend or terminate your access to the Services (or certain features of the Services) at our sole discretion, at any time, with or without notice, and with or without cause.

14. Governing Law and Dispute Resolution

Governing Law: These Terms and any dispute arising out of or in connection with these Terms or your use of the Services shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles.

Jurisdiction: You and Barranjoey agree that any judicial proceedings (other than small claims actions) will be brought in the courts of the State of Queensland, Australia, or the federal courts of Australia sitting in Queensland, unless applicable laws require otherwise.

15. Miscellaneous

Entire Agreement: These Terms (together with the Privacy Policy and any additional terms you agree to when using particular elements of the Service) constitute the entire agreement between you and Barranjoey regarding your use of dotty.cc, and supersede all prior and contemporaneous understandings, agreements, representations, or warranties, both written and oral, regarding such subject matter.
